Will and Trust Law
Can I use my will to name a guardian to care for my young children and mage their property?
Yes, people often designate guardians in their will to tend to their minor children after they die. But what they don’t realize is that that designation in the will is nothing more than an expression of their preference as to who they would like to be in charge of their children after they’re gone. In order for that person to obtain the legal authority to take care of those children, a formal legal process must be gone through, which is called a guardianship.
