Does all property have to go through probate when a person dies?

No. Only those things that were in the decedent’s individual name go through probate. Things that are governed by the operation of law such as joint ownership with the right of survivorship or by contractual arrangements such as beneficiary designations on retirement accounts, life insurance policies, [inaudible], those items do not go through probate.
