How is undue influence determined?

Undue influence is a complicated matter. It is dependent on all the surrounding facts and circumstances. In a general sense, undue influence is when a person in a position of trust and confidence uses that trust and confidence to coerce a person to make decisions or engage in behavior that they normally would not have made without the influence.
