Should I avoid probate?
Different lawyers will give you different answers regarding that question. In my practice, I prefer to think of controlling probate rather than avoiding probate completely. The reason for this is there are some aspects of probate that are beneficial to you and your heirs that you cannot avail yourself of unless the probate process is followed. We control probate by submitting ourselves to the rules of probate by keeping the assets out of the probate process.
