What is a durable power of attorney?

A durable power of attorney is a legal document that delegates to a third person, commonly referred to as your agent, the legal rights and authority to deal with your assets, in often cases just as if they were you. One of the features of a durable power of attorney is that it survives your incapacity unless somebody initiates guardianship proceedings against you. For this reason, durable powers of attorney are considered to be a lesser restrictive alternative to guardianship.
