Asset Protection Law
What is tenants by the entirety?
Tenants by the entirety is a unique form of joint ownership that is explicit to husbands and wives. Under the theory of tenants by the entirety, each spouse is considered to own 100% of the assets subject to the tenancy. There’s also a right of survivorship feature, which allows a surviving spouse to inherit the whole asset upon the death of the other tenant.
