Does an executor (personal representative) get paid?
A personal representative of an estate can get paid in accordance with the provisions of the will, or if the will is silent on the compensation of the personal representative, Florida has a statute which tells us how much a personal representative can be paid. However, it’s not uncommon for a personal representative to waive any compensation that they’re entitled to. The reason that they would waive it is if they are also the sole or a majority beneficiary under the will. Under those circumstances, the personal representative would not want to take compensation because to do so would be to convert assets that they’re going to receive any way into taxable income.
